AIA contracts provide for mediating a disagreement before litigation occurs, although few architects have had experience with the process, and even fewer know how to navigate it, prepare for it, and succeed in it. We’ll review basic, fundamental, and important information about how to prepare for mediation and equip yourself with the information and the organizational tools needed to get an effective result.
Learning objectives:
- Review the fundamentals of mediation-who the parties will be, what information will be exchanged, and how to analyze, organize, and then present that information effectively
- Discuss the conditions of the AIA agreements and examine ways to function in the adversarial environment to defuse tension and to reach resolution
- Develop practical, pragmatic solutions in analyzing and deciding acceptable outcomes in disputes.
