702 Looking for Trouble: Risk Assessments Under the Revised Sentencing Guidelines

Dennis Muse
Chief Executive Officer, Global Compliance
Steven Lauer
General Counsel, Global Compliance

The design for an ethics and compliance program that meets the standards embedded in the Sentencing Guidelines is based on a comprehensive risk assessment. In addition, the effectiveness of an ethics and compliance program should also be tested via a similar process. This entails looking for ways in which a business operation does, or might, violate the law.
From a business perspective, why would you want to look for and identify the problems in a business? What benefits might you draw from an ethics and compliance risk assessment? Participate in a discussion of the benefits of engaging in that process, including the following issues:

  • What would an ethics and compliance risk assessment examine?
  • How might a company most benefit from that process?
  • What business rationale (as opposed to the legal rationale) underlies the assessment?
