FR11 The 10 Worst Contractual Provisions

Few architects truly understand the negative impact onerous contract language can have on the sustainability of their professional practices, on their personal assets, on the success of their projects, and on their ability to carry out their obligations to protect public health and safety. Based on the records of AIA’s Commended Program of professional liability insurance, this fast-paced session will quantify risks generated by bad contract language and look at specific provisions taken from contracts proposed by clients to AIA members and modifications to the consensus AIA B141 language.
    Learning objectives:

  • Discuss the business and professional risks generated by onerous contractual provisions
  • Demonstrate how to educate clients on contract language as a guide to professional performance
  • Identify alternatives that provide real value without unmanageable risk that can be negotiated as substitutes to unreasonable provisions
